The Small Business Health Care Tax Credit is one of the most underutilized benefits available to Texas employers — and it can cover up to 50% of your premium contributions for employee health insurance.

What Is the Small Business Health Care Tax Credit?

The Small Business Health Care Tax Credit was created under the Affordable Care Act (ACA) to help small businesses and tax-exempt nonprofits afford health insurance for their employees. It's a dollar-for-dollar reduction in your federal tax liability — not just a deduction.

Who Qualifies?

To qualify for the maximum credit, your Texas business must meet all three criteria:

  1. Fewer than 25 full-time equivalent (FTE) employees — Part-time employees count as fractions of a full-time employee
  2. Average annual wages below $56,000 — The credit phases out as average wages increase above $31,800
  3. Pay at least 50% of employee-only premium costs — You must contribute at least half of the premium for each enrolled employee

The credit is available to for-profit businesses (as a tax credit) and tax-exempt nonprofits (as a refundable credit against payroll taxes).

How Much Is the Credit Worth?

For-profit small businesses can receive a credit of up to 50% of their premium contributions. Nonprofits can receive up to 35%.

Example: A Corpus Christi restaurant with 15 employees paying an average wage of $35,000 contributes $3,000/month ($36,000/year) toward employee health insurance premiums. The maximum credit would be:

$36,000 × 50% = $18,000 federal tax credit

The credit phases out gradually for businesses with 10–25 employees and average wages between $31,800 and $56,000.

The SHOP Marketplace Requirement

Can I Claim the Credit Multiple Years?

Yes — the Small Business Health Care Tax Credit can be claimed for two consecutive tax years. After that, you can still deduct your premium contributions as a business expense, which reduces your taxable income.

Other Tax Benefits for Texas Employers

Even if you don't qualify for the tax credit, employer premium contributions are fully tax-deductible as a business expense. Additionally, offering health insurance through a Section 125 Cafeteria Plan allows employees to pay their share of premiums with pre-tax dollars, reducing payroll taxes for both employer and employee.
